Not that I would support that in practice myself. But it is undoubtedly the case that we have politicisation. During the deliberations on Pinochet, one of the judges was found to be an Amnesty International - he honestly didn't, couldn't, see that as a conflict of interest. But of course it is a highly political statement. Our judges are now running rampant all over our constitution. I even heard one ex head of the judiciary state some years ago that if they felt a law was going to give rise to serious social conflict they would be entitled to cancel it but they would only ever use that power in extremis!
